The Commonwealth Continuity of Support Programme Quality and Safeguard Arrangements
The National Disability Insurance Scheme Quality and Safeguards Commission (NDIS Commission) is an independent agency. The NDIS Commission was established to improve the quality and safety of disability supports and services. The NDIS Commission regulates the disability services market and promotes safe and quality services.
To ensure national consistency, Commonwealth Continuity of Support (CoS) service providers and clients are to follow the NDIS Commission’s Quality and Safeguard arrangements.
From 1 July 2018, the NDIS Commission began operating in New South Wales and South Australia.
The NDIS Commission will begin operations in Queensland, Victoria, Tasmania, the Northern Territory and the Australian Capital Territory from 1 July 2019 and in Western Australia from 1 July 2020.
Until the NDIS Commission starts in your area, your state or territory current quality and safeguard arrangements will continue to apply.
CoS Service Provider Responsibilities under the NDIS Commission
All CoS service providers will need to register with the NDIS Commission and follow the National Disability Insurance Scheme (Code of Conduct) Rules 2018 and any relevant NDIS Key Rules. Registration will automatically transfer for service providers who have already registered with the National Disability Insurance Agency (NDIA).
Service providers who are unable to meet registration requirements can apply for an exemption. Contact the Department of Health at CommonwealthCos@health.gov.au. Applications will be considered on a case by case basis. If a service provider is exempt, they will still need to follow the NDIS Code of Conduct.
